Detailed Cancellation Policy

This Detailed Cancellation Policy (“Policy”) governs transaction cancellations facilitated through indianwatchconnoisseur.com (the “Platform”) and forms an integral part of the Terms & Conditions and Refund & Cancellation Policy of M/s. INDIAN WATCH CONNOISSEUR (“Indian Watch Connoisseur”, “I.W.C.”, “we”, “our”, or “us”).

This Policy should be read together with the Terms & Conditions and Refund & Cancellation Policy. This Policy expands upon the cancellation-related provisions contained in the Refund & Cancellation Policy and is intended to provide additional guidance regarding transaction stages, cancellation requests, transaction failures, seller defaults, compliance-related cancellations, and related matters.

By participating in any transaction through the Platform, users acknowledge and agree to be bound by this Policy.

Nothing contained in this Policy shall be interpreted as creating refund rights, return rights, inspection rights, counterfeit claim rights, chargeback rights, or other remedies beyond those expressly provided in the Refund & Cancellation Policy.

1. PURPOSE OF THIS POLICY

Indian Watch Connoisseur operates primarily as a marketplace facilitator and transaction intermediary connecting independent buyers and sellers of luxury watches.

Unlike conventional retail purchases, luxury watch transactions frequently involve:

  • Reservation of inventory;
  • Seller commitments;
  • Authentication procedures;
  • Verification procedures;
  • Compliance reviews;
  • KYC verification;
  • Logistics coordination;
  • Rejection of competing offers;
  • Allocation of resources and transaction-related expenses.

Accordingly, once a transaction has been confirmed, cancellation may result in financial consequences, operational costs, and commercial losses for one or more parties.

The purpose of this Policy is to establish the framework governing transaction cancellations, transaction withdrawals, seller defaults, transaction failures, cancellation requests, and related matters arising through the Platform.

Nothing contained in this Policy shall be interpreted as creating refund rights beyond those expressly provided in the Refund & Cancellation Policy.

2. TRANSACTION STAGES

For the purposes of this Policy, a transaction may be categorized as follows:

Stage 1: Inquiry Stage

The parties have expressed interest, but no commercial terms have been finalized.

Stage 2: Negotiation Stage

The parties are discussing pricing, specifications, availability, logistics, payment terms, authentication, verification requirements, or other transaction details.

Stage 3: Confirmation Stage

The buyer and seller have agreed upon the principal transaction terms and the buyer has paid the applicable Token Amount.

Stage 4: Fulfilment Stage

The watch has been reserved, authentication procedures may have commenced, shipping preparations have commenced, logistics have been arranged, or delivery is pending.

Stage 5: Completed Transaction

The watch has been delivered and accepted, subject always to any rights, remedies, claim procedures, inspection requirements, counterfeit review procedures, refund rights, or dispute resolution processes expressly preserved under the Refund & Cancellation Policy.

Indian Watch Connoisseur reserves the right, acting reasonably and in good faith, to determine the applicable transaction stage where uncertainty exists.

3. CANCELLATION PRIOR TO CONFIRMATION

A transaction may generally be cancelled without penalty before:

  • Commercial terms have been agreed;
  • A Token Amount has been paid;
  • The transaction has entered the Confirmation Stage.

Notwithstanding the foregoing, Indian Watch Connoisseur reserves the right to recover any reasonable costs already incurred on behalf of the parties in connection with the transaction.

Submission of an inquiry, expression of interest, participation in negotiations, or preliminary discussions shall not obligate any party to complete a transaction.

4. EFFECT OF TOKEN PAYMENT

Payment of a Token Amount signifies the buyer’s commitment to proceed with the transaction.

Upon receipt of the Token Amount:

  • The seller may reserve the watch;
  • The seller may reject alternative offers;
  • The watch may be removed from active marketing;
  • Indian Watch Connoisseur may allocate resources toward facilitating the transaction;
  • Compliance, verification, authentication, logistics, and transaction-related processes may commence.

Accordingly, cancellation rights become significantly restricted following payment of the Token Amount.

A transaction shall not be considered confirmed until the applicable Token Amount has been received.

5. BUYER CANCELLATION AFTER CONFIRMATION

Once a transaction has been confirmed and a Token Amount has been paid, the buyer acknowledges that:

  • The seller may have withdrawn the watch from the market;
  • The seller may have rejected alternative offers;
  • The seller may have reserved inventory exclusively for the buyer;
  • Indian Watch Connoisseur may have incurred administrative, verification, authentication, logistics, compliance, operational, professional, or transaction-related expenses;
  • Indian Watch Connoisseur and other affected parties may have acted in reliance upon the buyer’s confirmation.

Accordingly, cancellation by the buyer after confirmation may result in forfeiture of all or part of the Token Amount.

Indian Watch Connoisseur reserves the right, acting reasonably and in good faith, to determine the amount of any refund, deduction, adjustment, retention, or forfeiture based upon:

  • The stage of the transaction;
  • Seller commitments;
  • Costs incurred;
  • Administrative expenses;
  • Operational expenses;
  • Logistics expenses;
  • Verification expenses;
  • Authentication expenses;
  • Compliance-related expenses;
  • Losses suffered by affected parties;
  • Any other relevant facts or circumstances.

No refund shall be guaranteed merely because a buyer changes their mind, experiences buyer’s remorse, identifies a more favorable opportunity, encounters financial difficulties, changes personal preferences, or otherwise elects not to proceed after confirmation.

6. EFFECT OF CANCELLATION AFTER CONFIRMATION

The parties acknowledge and agree that cancellation of a confirmed transaction after payment of the Token Amount may result in losses that are difficult or impractical to accurately quantify.

Such losses may include, without limitation:

  • Lost sales opportunities;
  • Seller commitments and reliance;
  • Administrative expenses;
  • Verification expenses;
  • Authentication expenses;
  • Compliance and KYC costs;
  • Logistics and coordination expenses;
  • Marketing costs;
  • Opportunity costs;
  • Business disruption;
  • Other transaction-related losses.

Accordingly, where a confirmed transaction is cancelled by the buyer without lawful justification, all or part of the Token Amount may be forfeited, retained, refunded, or otherwise treated in accordance with the Refund & Cancellation Policy.

The amount of any refund, deduction, adjustment, retention, or forfeiture shall be determined by Indian Watch Connoisseur acting reasonably and in good faith after considering all relevant circumstances of the transaction.

7. SELLER CANCELLATION AFTER CONFIRMATION

If a seller withdraws from a confirmed transaction after accepting a deal, Indian Watch Connoisseur may take one or more of the following actions:

  • Issue a full refund of the Token Amount to the buyer;
  • Suspend the seller;
  • Permanently remove the seller from the Platform;
  • Restrict future listings;
  • Take any other action deemed appropriate.

Indian Watch Connoisseur reserves the right to maintain records of seller conduct for fraud prevention, risk management, compliance, dispute resolution, and platform integrity purposes.

Repeated cancellations may result in permanent exclusion from future transactions.

8. SELLER DEFAULT

Where a seller withdraws from, obstructs, delays, interferes with, or otherwise fails to complete a confirmed transaction without lawful justification, Indian Watch Connoisseur reserves the right to:

  • Suspend or terminate the seller’s access to the Platform;
  • Restrict future listings;
  • Record the cancellation for compliance and fraud-prevention purposes;
  • Refuse future transaction facilitation services;
  • Cooperate with affected parties in resolving resulting disputes;
  • Take any other action reasonably necessary to protect the Platform and its users.

Repeated cancellations, failure to honour commitments, misrepresentation of inventory, failure to disclose material facts, or other conduct that undermines marketplace integrity may result in permanent removal from the Platform.

9. CANCELLATION DUE TO FAILURE OF KYC

Indian Watch Connoisseur may cancel, suspend, postpone, restrict, or refuse to proceed with any transaction if:

  • KYC verification cannot be completed;
  • False, inaccurate, misleading, incomplete, altered, or fraudulent information is provided;
  • Fraud indicators are identified;
  • Compliance concerns arise;
  • Required documentation is not supplied;
  • Identity verification cannot be completed;
  • Regulatory concerns are identified;
  • Ownership verification concerns arise;
  • The transaction otherwise presents unacceptable risk.

Failure to provide requested KYC information may result in suspension, cancellation, restriction, delay, or refusal of services.

In such circumstances, Indian Watch Connoisseur reserves the right, acting reasonably and in good faith, to determine the appropriate treatment of any amounts paid after considering all relevant circumstances.

10. CANCELLATION DUE TO SUSPECTED FRAUD

Indian Watch Connoisseur reserves the right to immediately suspend, postpone, investigate, restrict, or cancel any transaction where fraud, attempted fraud, identity theft, money laundering concerns, payment irregularities, suspicious activity, unlawful conduct, misrepresentation, document manipulation, or other prohibited conduct is suspected.

Indian Watch Connoisseur may cooperate with:

  • Banks;
  • Payment processors;
  • Financial institutions;
  • Regulatory authorities;
  • Government agencies;
  • Law enforcement authorities;
  • Fraud prevention providers;
  • Other authorized entities.

No compensation shall be payable by Indian Watch Connoisseur for actions taken in good faith to protect the Platform, its users, its legitimate business interests, or its legal and compliance obligations.

11. CANCELLATION DUE TO UNAVAILABLE INVENTORY

A transaction may be cancelled if:

  • The watch is no longer available;
  • The watch has been damaged;
  • Ownership cannot be verified;
  • Authenticity concerns arise;
  • The seller loses authority to sell the watch;
  • The watch becomes subject to a legal claim, dispute, lien, encumbrance, investigation, or ownership challenge;
  • Delivery becomes impossible or commercially impracticable.

Where appropriate, amounts paid by the buyer may be refunded in accordance with the Refund & Cancellation Policy.

Indian Watch Connoisseur shall not be liable for indirect, consequential, speculative, opportunity, or market-related losses arising from such cancellation.

12. CANCELLATION DUE TO FORCE MAJEURE

Indian Watch Connoisseur may cancel, suspend, postpone, delay, or otherwise modify transactions due to circumstances beyond its reasonable control, including:

  • Natural disasters;
  • Floods;
  • Fires;
  • Earthquakes;
  • War;
  • Civil unrest;
  • Government restrictions;
  • Internet outages;
  • Payment processor failures;
  • Courier disruptions;
  • Security threats;
  • Cybersecurity incidents;
  • Telecommunications failures;
  • Pandemics;
  • Epidemics;
  • Acts of God;
  • Other force majeure events.

Indian Watch Connoisseur shall not be liable for losses, damages, delays, expenses, or consequences arising from such events.

13. NON-CANCELLABLE TRANSACTIONS

The following transactions may be treated as non-cancellable:

  • Transactions where shipping has commenced;
  • Transactions involving special sourcing arrangements;
  • Transactions involving third-party commitments;
  • Transactions involving custom procurement;
  • Transactions otherwise designated as non-cancellable in writing.

Nothing contained in this section shall limit any rights, remedies, counterfeit claim procedures, dispute procedures, or refund rights expressly preserved under the Refund & Cancellation Policy.

14. NO SPECIFIC PERFORMANCE

Indian Watch Connoisseur does not guarantee that any transaction will proceed to completion and shall not be obligated to compel, force, or require any buyer or seller to complete a transaction.

Indian Watch Connoisseur acts primarily as a marketplace facilitator and transaction intermediary and does not guarantee the performance of any buyer, seller, logistics provider, authentication provider, payment provider, or other third party.

The remedies available in connection with cancelled transactions shall be limited to those expressly provided under the Terms & Conditions, Refund & Cancellation Policy, this Detailed Cancellation Policy, and applicable law.

15. CANCELLATION REQUEST PROCEDURE

Cancellation requests must be submitted in writing to:

The request should include:

  • Full name;
  • Contact details;
  • Transaction information;
  • Watch details;
  • Reason for cancellation;
  • Supporting documentation where applicable.

Submission of a cancellation request does not automatically result in approval.

Indian Watch Connoisseur may request additional information, documents, records, communications, photographs, videos, identification records, or supporting evidence before making any determination.

16. INSPECTION, ACCEPTANCE, AND POST-DELIVERY CLAIMS

Buyers must inspect the watch immediately upon delivery and prior to any use, modification, servicing, transfer, resale, or alteration of the watch.

Acceptance of delivery constitutes acknowledgment that the watch has been received and that the buyer has been afforded a reasonable opportunity to inspect the watch.

Failure to notify Indian Watch Connoisseur of a qualifying claim within the applicable claim period established under the Refund & Cancellation Policy shall constitute final acceptance of the watch.

Use of the watch, modification of the watch, servicing of the watch, transfer of the watch, resale of the watch, replacement of components, or alteration of the watch following delivery may affect eligibility to assert a claim.

All counterfeit claims, refund requests, acceptance disputes, and post-delivery claims shall be governed exclusively by the Refund & Cancellation Policy.

17. COUNTERFEIT WATCH CLAIMS

A refund, cancellation, reversal, or other remedy based upon an allegation that a watch is counterfeit shall be governed exclusively by the Refund & Cancellation Policy.

Without limitation, any counterfeit claim must satisfy all requirements set forth in the Refund & Cancellation Policy, including applicable claim periods, evidentiary requirements, inspection requirements, and review procedures.

Submission of a counterfeit claim shall not automatically entitle a buyer to a refund, reversal, cancellation, replacement, or other remedy.

Indian Watch Connoisseur reserves the right to obtain additional opinions, inspections, evaluations, reports, documentation, or expert reviews before making any determination regarding a counterfeit claim.

18. UNACCEPTABLE EVIDENCE

For the avoidance of doubt, and consistent with the Refund & Cancellation Policy, the following shall not constitute acceptable evidence in support of a counterfeit claim:

  • Social media posts;
  • Online forums;
  • Internet articles;
  • Influencer opinions;
  • Independent watchmakers;
  • Dealers;
  • Collectors;
  • Community opinions;
  • Unofficial authentication services;
  • Verbal statements;
  • Anonymous reports;
  • Informal correspondence;
  • Online discussion groups;
  • Video content;
  • Blog posts;
  • Unverified reports.

Only evidence expressly recognized under the Refund & Cancellation Policy shall be considered acceptable for purposes of counterfeit claim review.

19. REFUND APPROVAL REQUIREMENTS

Where a cancellation, dispute, counterfeit claim, or other qualifying event results in potential refund eligibility, all refund approval requirements set forth in the Refund & Cancellation Policy shall apply.

Without limitation:

  • The watch may be required to be returned;
  • The watch may be required to be received in substantially the same condition as delivered;
  • Accessories, boxes, documentation, warranty cards, certificates, links, straps, packaging materials, and related items originally supplied may be required to be returned;
  • Indian Watch Connoisseur may be required to complete its review process;
  • Additional information and documentation may be required.

No refund shall be issued until Indian Watch Connoisseur has determined, acting reasonably and in good faith, that the applicable requirements have been satisfied.

20. REFUND PROCESSING

Where a refund is approved following cancellation, dispute review, counterfeit review, or other qualifying circumstance, refund processing shall be governed by the Refund & Cancellation Policy.

Indian Watch Connoisseur shall not be responsible for delays attributable to banks, payment processors, card networks, financial institutions, regulatory reviews, compliance reviews, technical failures, or circumstances beyond its reasonable control.

No interest, compensation, damages, opportunity costs, market losses, or other amounts shall accrue on refunded sums except where required by applicable law.

21. CHARGEBACKS AND PAYMENT REVERSALS

Users agree not to initiate unjustified chargebacks, payment reversals, payment disputes, recovery proceedings, banking disputes, or similar claims after voluntarily entering into a confirmed transaction.

Any chargeback, payment dispute, recovery action, investigation, regulatory inquiry, or fraud review shall be governed by the applicable provisions of the Refund & Cancellation Policy and the Terms & Conditions.

Indian Watch Connoisseur reserves all rights and remedies available under applicable law in connection with chargebacks, payment disputes, recovery proceedings, and improper attempts to reverse valid transactions.

22. ABUSE OF CANCELLATION RIGHTS

Indian Watch Connoisseur reserves the right to suspend, restrict, terminate, or otherwise take appropriate action against users who:

  • Repeatedly enter transactions without genuine intent to complete them;
  • Abuse cancellation rights;
  • Submit misleading information;
  • Cause repeated transaction failures;
  • Engage in disruptive conduct;
  • Interfere with legitimate transactions;
  • Submit fraudulent claims;
  • Abuse refund procedures;
  • Misuse payment dispute mechanisms;
  • Otherwise undermine the integrity of the Platform.

Indian Watch Connoisseur reserves all rights and remedies available under applicable law in connection with fraudulent, abusive, misleading, or bad-faith conduct.

23. REVIEW OF CANCELLATION DISPUTES

Indian Watch Connoisseur may review:

  • Communications;
  • KYC records;
  • Payment records;
  • Transaction history;
  • Authentication records;
  • Delivery records;
  • Photographs;
  • Videos;
  • Compliance records;
  • Investigation records;
  • Supporting evidence;
  • Electronic records;
  • Metadata and related technical records.

Users agree to cooperate fully and in good faith with any reasonable review, investigation, compliance review, dispute resolution process, or information request.

Failure to cooperate may result in rejection of requests, claims, disputes, cancellation requests, or refund requests.

Indian Watch Connoisseur may rely upon records maintained by it in evaluating disputes, claims, investigations, and transaction-related issues.

24. POLICY CHANGES

Indian Watch Connoisseur reserves the right, at its sole discretion, to amend, modify, update, supplement, replace, revise, suspend, or discontinue this Detailed Cancellation Policy at any time.

Updated versions shall be published on the Platform together with an updated revision date.

Users are responsible for periodically reviewing this Policy to remain informed of any updates.

Continued use of the Platform following publication of an updated Policy shall constitute acceptance of such changes.

25. RESERVATION OF RIGHTS

Indian Watch Connoisseur expressly reserves all rights not expressly granted under this Policy.

Without limitation, Indian Watch Connoisseur reserves the right to investigate transactions, review cancellations, request documentation, preserve records, refuse requests, suspend services, restrict access, cooperate with authorities, and take any action reasonably necessary to protect its users, operations, compliance obligations, platform integrity, security interests, or legitimate business interests.

Nothing contained in this Policy shall limit any rights, remedies, protections, defenses, privileges, or powers available to Indian Watch Connoisseur under applicable law, equity, contract, the Terms & Conditions, or the Refund & Cancellation Policy.

26. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Indian Watch Connoisseur shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, speculative, or economic damages arising out of or relating to:

  • Cancellation requests;
  • Transaction failures;
  • Seller defaults;
  • Inventory unavailability;
  • Fraud investigations;
  • Compliance reviews;
  • KYC reviews;
  • Refund determinations;
  • Dispute reviews;
  • Delays in processing;
  • Actions taken in good faith under this Policy.

Without limitation, Indian Watch Connoisseur shall not be liable for:

  • Loss of profits;
  • Loss of opportunity;
  • Loss of anticipated savings;
  • Loss of business;
  • Loss of goodwill;
  • Loss of reputation;
  • Loss of value;
  • Market fluctuations;
  • Investment performance;
  • Business interruption;
  • Emotional distress;
  • Consequential losses of any kind.

Users acknowledge that Indian Watch Connoisseur acts primarily as a marketplace facilitator and transaction intermediary and does not assume the commercial risks associated with transactions between independent buyers and sellers.

Nothing contained in this section shall exclude liability that cannot lawfully be excluded under applicable law.

27. SURVIVAL

Any provisions of this Policy which by their nature should survive completion of a transaction, cancellation of a transaction, termination of Platform access, closure of an account, or cessation of use of the Platform shall survive and remain fully enforceable.

Without limitation, provisions relating to records retention, fraud prevention, investigations, compliance reviews, chargebacks, payment disputes, counterfeit claims, dispute resolution, limitation of liability, enforcement rights, evidentiary use of records, and protection of legitimate business interests shall survive termination or completion of a transaction.
